Help for Employees
If you were employed by a company which is now insolvent and you are owed wages, accrued holiday pay, notice pay or redundancy payment, you will be able to submit a claim to the Redundancy Payments Office, part of the Insolvency Service. Generally, they are able to pay: -
-
Redundancy pay
-
Wages - up to a maximum of eight weeks
-
Holiday pay - up to a maximum of six weeks
-
Notice pay - one weeks pay for each year of service, up to twelve weeks
All payments are subject to a statutory maximum weekly wage which is currently £400 (For redundancies from 1 February 2012 it will be £440).
Claims for other payments, such as Statutory Sick Pay, Maternity Pay and Paternity Pay, are handled by HM Revenue & Customs. The required forms can be obtained from JobCentres.
A more detailed explanation of what the Insolvency Service can pay is given in their factsheet which is available from your employer's liquidator, administrator or from the links below. The claim form (RP1) should be completed and, usually, returned to the Insolvency Practitioner.
